Regulation 4 of CAR 2006 (A Duty To Manage Asbestos in Non-Domestic Premises)

The new and compulsory Regulation 4 of the Control of Asbestos Regulations (CAR) 2006 legislation requires employers to protect anyone in their employ from exposure to asbestos including employees, contractors, visitors and the public. The HSE have been enforcing this regulation since 21st May 2004 and will continue to do so until Duty Holders responsible for non-domestic premises within UK businesses, organisations and Government departments are compliant. Those who fail to comply will risk crippling fines and even imprisonment.

Managing asbestos to meet current legislation and avoid fines for non-compliance (Type 1 and 2 Asbestos Surveys)

To comply, an Asbestos Management Plan is required by Duty Holders this must be accompanied by a register or log of asbestos containing materials, their location and condition for ongoing maintenance and management.

Preparation for demolition or major refurbishment (Type 3 Asbestos Survey)

Prior to the demolition or major refurbishment of any property in the UK it is a legal requirement to identify where the Asbestos Containing Materials (ACM's) are located in the building. This is to ensure that asbestos is not disturbed while site works are being carried out.

An asbestos survey is essential to identifying where the ACM's are located and has the added benefit of being a document that can be used to tender for the removal of asbestos.
